This morning, halfway through my submission, the learned High Court judge stopped me. She then pronounced that she had made up her mind and went on to dismiss the Plaintiff's summary judgment application with cost. My opposing counsel, acting for a renowned private hospital in Penang, was trying to obtain various injunctive and declaratory orders against my individual client by way of summary judgment for passing off. The private hospital, in this case, claims goodwill and reputation not in the hospital and healthcare business, but in transport and limousine services.
